The consent for a minor to travel with an accompanying adult will be valid until they reach the age of majority.
An accompanying person is required when a minor travels abroad, but there are situations where it is possible to travel without written parental authorisation, but sometimes a document signed by a notary or lawyer might be required.
A written and notarized consent of the parents is not required if:
- The child travels abroad without parents with an accompanying person in the Schengen area;
- The child flies to a foreign country with one of the parents;
- The child is not over 18 years of age and has entered into marriage, i.e. acquired civil capacity;
- The child has been declared emancipated by a court ruling.
There are some exceptions, but in other cases the consent of the parents, certified by a notary or solicitor, is usually required. It is important to note that even in cases where consent is not legally required, all airlines reserve the right to request this document at any time, so we recommend that our clients have a notarized or apostille-certified parental consent if the child is traveling with someone other than their parents.
In addition, it is useful to know that one of the parents, when traveling with a minor to live in another country, must in all cases inform the other parent about this and have their permission for such a change of residence. In case one of the parents travels with a child to live in a foreign country, the written consent of the other parent, who will not travel together, must be obtained (to allow for the minor’s permanent residence in a foreign country).
